Referral Promotion - General Terms and Conditions

These Referral Promotion Terms and Conditions govern your participation in any referral program or promotion ("Referral Promotion") offered by the Promoter. By participating in a Referral Promotion, both the referring party (“Referrer”) and the referred customer (“Referred Customer”) (collectively, “you”, or “your”) agree to be bound by these Terms, as well as our Website Terms and Conditions, Privacy Policy, and any applicable promotional materials or campaign-specific rules (together, the "Agreement"). These Terms apply to all Referral Promotions unless separate terms are expressly provided for a specific promotion, in which case those specific terms will apply to the extent of any inconsistency.

Promoter

TWMT Pty Ltd ACN 621 581 584 trading as Coinstash AU (“Coinstash”, “we”, “our” or “us”).

Eligibility

To qualify for the Referral Promotion:

If you are a Referrer, you must:

be at least 18 years of age;

be residents of Australia;

not be excluded from the Coinstash platform;

not have found to be in breach of the Agreement at all times;

are not employees, contractors or agents of Coinstash, unless explicitly permitted; and

share their unique referral code provided by us.

If you are a Referred Customer, you must:

be at least 18 years of age;

be residents of Australia;

be a new customer who has not previously held an account with us;

sign up using a valid referral code;

complete verification and any other onboarding requirements;

not be excluded from the Coinstash platform;

not have found to be in breach of the Agreement at all times; and

are not employees, contractors or agents of Coinstash, unless explicitly permitted.

We reserve the right to verify your eligibility at any time and may suspend or terminate your access to the Referral Promotion if we determine you are not eligible.

Referral Codes and Mechanics

We may make available one or more referral codes ("Referral Codes") to the Referrers, which may be shared with the Referred Customers to invite them to join or transact on our platform.

The use of Referral Codes must comply with the following conditions:

Referral Codes must be used only for personal and non-commercial purposes;

You must not publish or distribute Referral Codes in a misleading, unlawful, deceptive, or spam-like manner (including via paid advertising, automated systems, or public forums not intended for such use); and

You must not impersonate others, create fake accounts, or mislead users in connection with Referral Codes.

The use of a Referral Code by a Referred Customer may result in promotional rewards to the Referrer, the Referred Customer, or both, subject to the terms of the specific Referral Promotion. 

Rewards

Rewards may vary and the nature, amount, and conditions of any reward (including loyalty points, trading fee discounts, cash, credits, or other benefits) associated with a Referral Promotion will be described in the relevant marketing or promotional materials.

All rewards:

are subject to verification and our sole discretion;

are non-transferable, non-exchangeable, and non-refundable;

may be subject to expiry dates, minimum activity thresholds, or additional eligibility requirements as described in the applicable promotion(s);

are not guaranteed and may be revoked, withheld, or clawed back if we determine there was any fraud, abuse, or breach of these Terms.

Rewards may include but are not limited to:
bonus;
fee savers;
fee discount;
STASH Points rewards; and
physical item rewards, and more.

We may cap the number of referral rewards you can receive per promotion or per period.

Additional Conditions for SMSF Participants

Where a Referral Promotion is open to Self-Managed Super Fund (“SMSF”) accounts, eligible SMSF participants must warrant and represent that:

cryptocurrency and/or digital assets are expressly permitted under their SMSF’s current investment strategy; and

all necessary approvals or consents have been obtained from the relevant trustees, investment decision-makers, or advisers.

By participating in the Promotion, SMSF users acknowledge and agree that Coinstash does not verify compliance with SMSF investment strategies or trustee obligations, and that it is the responsibility of the SMSF trustees to ensure all activities undertaken on the platform are in accordance with applicable superannuation laws and the governing rules of the SMSF.

Other T&Cs

We make no warranties or representations regarding the availability, accuracy, or operation of any Referral Promotion.
To the maximum extent permitted by law, will not be held liable for any losses incurred by any person in connection with their participation in the Referral Promotion, including but not limited to losses incurred by errors, omissions, or technical malfunctions that may occur in connection with the Referral Promotion.
Additionally, we reserve the right to modify, suspend, or terminate any Referral Promotion, or these Terms, at any time without prior notice.
We may also exclude you from participation or withhold or cancel rewards if we suspect you have breached any part of the Agreement, engaged in fraud or misconduct, or used the Referral Promotion in a manner not reasonably intended by us.
You are solely responsible for any tax liabilities or reporting obligations arising from your receipt of any referral rewards. We may withhold taxes or report rewards to relevant authorities as required by applicable law.
These rules shall be governed by and construed in accordance with the laws of Queensland, Australia and shall be subject to the exclusive jurisdiction of the Queensland courts.
